Brannon Gardens Condominium Association, Inc. (BGCA)
BGCA is organized as a Kentucky non-stock, non-profit corporation, the members of which are each an owner of record of a Unit (Condominium).
As do most Condominium Associations, BGCA assesses a monthly maintenance fee, which is currently $450 per Unit. The monthly maintenance fee includes the following association services:
- Common Area Landscaping including mowing, trimming, and irrigation
- Water and sewer
- Exterior maintenance of buildings, streets, streetlights, grounds, and other common areas
- Snow removal
- Clubhouse with indoor pool and fitness room
- Professional Management and Accounting
- General common area liability and property insurance for all structures (The Unit Owner is responsible for insuring the upgrades of the unit and personal property). - Reserve Fund for items such as roof replacements, streets, clubhouse, and other common elements
According to the 2nd Amendment to the BGCA By-Laws: Upon the sale or transfer of a condominium unit, a special assessment of three (3) times the current monthly assessment, in effect at the time of closing, shall be due and payable at the time of said closing. Said special assessment shall not be deemed to be an advance payment of any assessment and may not be paid in lieu of any assessment. Said special assessment shall be the personal obligation of the new Unit Owner and shall constitute a lien against the Unit. Notwithstanding anything to the contrary herein, the special assessment shall not be due as a result of a conveyance of a Unit to an Owner's spouse, child, corporation, partnership, company or legal entity in which the Owner is a principal. Funds collected as a result of the special assessment shall be allocated to the Capital Reserve account of the Association. The special assessment shall go into effect beginning December 1, 2020.
Selling or Buying a Unit at Brannon Gardens
In accordance with the Kentucky Condominium Act (KRS 381.9203), each seller must order from the Association a "Sellers Disclosure Certificate" (Certificate) before a sale contract is signed. This certificate contains all of the information that must be disclosed to a buyer by the seller including any dues, special assessments, lawsuits, financial statements, budgets, Restrictions, Rules and Regulations, and all other Governing Documents. Providing a Certificate to the potential buyer protects the Association, the seller, and the seller's realtor for "failure to disclose association financial conditions' or " undisclosed restrictions" at the time of a sale.

In addition to condo door keys and garage door openers, buyers should collect the Clubhouse key fob from sellers at or before closing to avoid being charged a fee of $25 for a new key fob.
Sellers are responsible for notifying the BGCA Board of buyers' information (name, phone number, and email address) and closing dates at least 10 days prior to closings.
